These Terms of Use (the “Terms”) govern your access to and use of leads.lionpridefinancial.com and Lion Pride Financial LLC’s related account areas, marketplace, leads, appointments, reports, products, and services (collectively, the “Service”). In these Terms, “Lion Pride,” “we,” “us,” and “our” mean Lion Pride Financial LLC. By creating an account, placing an order, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement. If you use the Service for a business or other organization, you represent that you have authority to bind it to these Terms.
You must provide and maintain accurate, current, and complete account and billing information. You are responsible for protecting your credentials and for all activity under your account. Promptly notify us if you suspect unauthorized access. We may reject a registration, require verification, or limit the number of accounts associated with a person or organization.
Lead information and outcomes
Lead information may come from public records, data providers, user submissions, and our business operations. It may be incomplete, outdated, duplicated, or inaccurate. You are responsible for verifying information before relying on it and for deciding whether and how you may contact any person. Access to a lead does not guarantee a response, sale, appointment, eligibility, conversion, or other outcome.
Unless an order expressly states otherwise, lead information is licensed to you for your own lawful, internal business use. You may share it only with personnel and contractors who need it for that purpose and who are bound to protect it. You may not resell, publish, sublicense, or otherwise distribute lead information without our written permission.
Lawful and acceptable use
You may use the Service only for lawful business purposes. You are solely responsible for complying with privacy, telemarketing, insurance, advertising, consumer-protection, licensing, do-not-call, consent, and other laws that apply to you and your communications. You must honor applicable opt-out and suppression requests.
You may not misuse personal information; send unlawful, abusive, or deceptive communications; impersonate another person; infringe another person’s rights; attempt unauthorized access; interfere with or burden the Service; scrape or bulk-export information except through an authorized feature; introduce harmful code; evade restrictions or usage limits; test vulnerabilities without written authorization; or use the Service in a way that could harm Lion Pride, another user, or any person whose information appears in the Service.
Orders, prices, and payment
The description, price, quantity, subscription period, and other terms shown at checkout form part of your order. You authorize us and our payment providers to charge the payment method you supply. You represent that you are authorized to use that method and that your billing information is accurate. We may reject or cancel an order because of availability, an error, suspected fraud, or an unauthorized or unlawful transaction. We may correct pricing or description errors before fulfillment and may restrict access for failed, reversed, or disputed payments.
If an order renews automatically, the renewal schedule and price presented when you subscribe apply until you cancel. You may cancel future renewals through the available account controls or by contacting us before the next charge. Cancellation stops future renewals but does not retroactively refund a completed period unless required by law.
Refunds
Because access to leads, appointments, direct-mail generation, and other digital services is delivered promptly, purchases are final except where required by law, expressly stated at checkout, or covered by the limited exceptions below.
You may request review within seven days after purchase if the item is a duplicate lead, contains only a P.O. box and no phone number, is an appointment delivered without a promised recording, or has an invalid, blank, or missing lead image. If we confirm the issue, we will provide an appropriate refund or account credit. A request made after seven days is not eligible under these exceptions. Contact us with the order number and enough information to evaluate the request.
Communications
Marketing and new-record report emails are optional and depend on the choice you make. You may change that choice in your profile or through the preference link in an email. Your marketing choice does not affect necessary account, security, purchase, billing, or service communications. You are responsible for keeping your contact information current.
Your materials
You retain ownership of information and materials you submit to the Service. You grant Lion Pride a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and otherwise use those materials only as reasonably necessary to provide, secure, support, and improve the Service and to comply with law. You represent that you have the rights and permissions needed to submit them.
Lion Pride property and limited license
The Service and its content, selection, organization, branding, and other materials are owned by Lion Pride or its licensors and are protected by applicable law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your lawful internal business purposes. No other rights are granted. If you provide suggestions or feedback, we may use them without restriction or compensation to you.
Other services and links
The Service may rely on or link to services operated by others, including payment, communications, analytics, data, and hosting providers. Their services may be governed by separate terms and policies. We are not responsible for third-party services outside our control.
Suspension and termination
You may stop using the Service at any time. We may restrict, suspend, or terminate access when reasonably necessary to address nonpayment, a security or legal risk, suspected fraud, unlawful conduct, violation of these Terms, harm to others, or discontinuation of all or part of the Service. Termination does not eliminate obligations or liabilities that arose before termination. Provisions that by their nature should survive will survive, including payment obligations, ownership provisions, disclaimers, liability limits, indemnity, and general terms.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Lion Pride disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely accurate, or that it will produce any particular business result. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Lion Pride and its affiliates, officers, employees, contractors, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Service or these Terms, even if advised that such damages were possible. Lion Pride’s total liability for all claims arising from the affected Service will not exceed the amount you paid Lion Pride for that Service during the three months before the event giving rise to the claim. These limits do not apply where prohibited by law.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Lion Pride and its affiliates, officers, employees, contractors, and providers from claims, losses, liabilities, judgments, penalties, and reasonable costs, including attorneys’ fees, arising from your unlawful outreach or other conduct, your misuse of lead or personal information, materials you submit, your violation of these Terms or applicable law, or your infringement of another person’s rights.
Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally. Unless applicable law requires otherwise, any legal proceeding must be brought in the state or federal courts serving Montgomery County, Maryland, and each party consents to their jurisdiction and venue.
Changes and general terms
We may update these Terms by posting a revised version and providing additional notice when required. The revised Terms apply from the stated effective date. If you continue to use the Service after that date, you accept the revised Terms. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, sale, or by operation of law. These Terms, the Privacy Policy, the terms presented with an order, and any written agreement between you and Lion Pride are the entire agreement concerning the Service; a separately signed agreement controls if it expressly conflicts with these Terms.
